The REAL ID Act, passed by the U.S. Congress in 2005, requires changes to state standards, procedures and requirements for the issuance of driver's licenses and identification cards if they are to be accepted as identity documents by the federal government for the purpose of accessing federal facilities. Although Pennsylvania has not yet complied with the provisions of the Act, federal courthouses are exempted from the provisions of the REAL ID Act in deference to the constitutional right of defendants and other members of the public to access to court proceedings. Accordingly, the U.S. Marshals Service will continue to accept Pennsylvania driver’s licenses as valid proof of identification for entering the Byrne U.S. Courthouse and other Eastern District court facilities.
